The 24HR CAR UNLOCKING EMERGENCY ROADSIDE SERVICES’ Terms and Conditions (“User Terms”) constitute a legally binding agreement between 24HR CAR UNLOCKING EMERGENCY ROADSIDE SERVICES (“24HR CAR UNLOCK”, “we”, “us”, or “our”), the owner and operator of the https://24hrcarunlocking.com/ website and its related software application and platform (hereafter, collectively referred to as the “24HR CAR UNLOCK”) and you (“you” or “your”), the user of 24HR CAR UNLOCK. BY USING 24HR CAR UNLOCK IN ANY FORM OR FASHION (INCLUDING, WITHOUT LIMITATION, NAVIGATING https://24hrcarunlocking.com/ OR UTILIZING THE 24HR CAR UNLOCK MOBILE APPLICATION OR ONLINE PLATFORM), YOU ACKNOWLEDGE AND AGREE TO THESE USER TERMS, AND 24HR CAR UNLOCKING EMERGENCY ROADSIDE SERVICES’PRIVACY POLICY, WHICH CAN BE FOUND AT https://24hrcarunlocking.com/privacy-policy/ AND WHICH ARE INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, YOU MAY NOT USE 24HR CAR UNLOCK.

THE USER TERMS ARE INTENDED FOR ALL USERS OF 24HR CAR UNLOCK, INCLUDING THOSE WHO ARE SIMPLY NAVIGATING THE WEBSITE OR THOSE WHO REGISTER AN ACCOUNT. HOWEVER, DIFFERENT SECTIONS OF THE USER TERMS AFFECT USERS DIFFERENTLY, SO PLEASE BE SURE TO READ THESE TERMS AND CONDITIONS CAREFULLY.

1. 24Hr Car Unlocking Emergency Roadside Services Overview

24Hr Car Unlocking Emergency Roadside Services provides an online platform where users can connect with vendors offering roadside assistance and towing services (hereafter, “Providers”). Users can access our services through the https://24hrcarunlocking.com/, our mobile application, or via certain third-party platforms, accessible on a single mobile device (smartphone) or computer. We act as a facilitator of the connection between users and Providers but are not directly involved in or a party to the transactions between them.

We do not have control over the quality, safety, legality, or any other aspect of the services offered by Providers, nor the accuracy of the information or pricing they provide. We are not a broker, agent, or insurer for users or Providers. We make no representations, warranties, or guarantees regarding any content or information provided by users or Providers. We encourage direct communication between users and Providers through the tools available on our platform.

All transactions between users and Providers are conducted at each party’s own risk. We prioritize customer information and privacy as outlined in our Privacy Policy https://24hrcarunlocking.com/privacy-policy/, which is fully incorporated herein by reference.

2. 24Hr Car Unlocking Emergency Roadside Services Registration Terms

Registration with 24Hr Car Unlocking Emergency Roadside Services is subject to the following terms and conditions:

(a) Eligibility: By registering with our service, you affirm that all registration information you submit is accurate and truthful, including your name, mobile telephone number, vehicle details (make, model, year, etc.), and payment information. We reserve the right, at our sole discretion, to refuse service to anyone and to modify eligibility criteria at any time. If you are an individual, you confirm that you are of legal age to form a binding contract, and if registering on behalf of an entity, you are authorized to bind the entity to these terms.

(b) Security of Registration Information: You are responsible for maintaining the confidentiality and accuracy of your registration information. You are liable for all activities and damages resulting from your failure to maintain password confidentiality. You agree to promptly notify us of any unauthorized use of your account or any breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.

(c) Compliance: You agree to comply with all applicable local laws regarding online conduct and acceptable content. You must also adhere to our policies as outlined in these User Terms and any other operating rules, policies, and procedures that we may publish from time to time on our platform, each of which is incorporated by reference and may be updated without notice.

3. How to Use 24Hr Car Unlocking Emergency Roadside Services

Requesting Service: Our platform allows you to request roadside assistance or towing services from independent service providers (“Providers”). When you request a service, your device’s GPS or your computer’s Internet Protocol address will ask for your permission to share your location. This location data is then sent to the Provider to facilitate the service.

Provider Discretion: Providers have the sole discretion to accept or reject each service request. They also decide whether to use our platform to receive service leads. If a Provider accepts your request, our application will notify you and provide details about the Provider, including their vehicle information and contact details.

Payment Authorization: Upon selecting a Provider, we may place a pre-authorization hold on your credit card for the estimated service cost. The final charge may vary based on the actual service provided.

Cancellation Policy:

  • You can cancel your request within 5 minutes of the Provider dispatching a vehicle to your location without any charge.
  • If you cancel after 5 minutes of dispatch but before the Provider arrives, a $35 non-refundable service charge applies.
  • A full-service charge applies if you cancel after the Provider arrives, if the service requirements are different than initially stated, or if you are not present (Gone on Arrival) at the service location.

Additional Charges: If the actual service required differs from your initial description (due to inaccurate or incomplete information), the initial quote may not be binding. You will be responsible for any additional charges incurred for the required service.

Service Provision: Please note that 24Hr Car Unlocking Emergency Roadside Services is not the provider of roadside assistance or towing services. We offer a platform for you to connect with independent Providers. Any service agreement is between you and the Provider, and we are not a party to that agreement. You agree to release us from any liability related to the acts or omissions of the Provider.

4. Your Use of 24Hr Car Unlocking Emergency Roadside Services

By utilizing our services, you agree to adhere to the following terms and conditions:

  • Accuracy of Information: You must ensure that all information you provide to us is accurate and complete. We reserve the right to verify your information and to refuse service for any reason.
  • Device Compatibility: You are responsible for using a compatible mobile device or computer to access our services. We are not liable if your device is incompatible, and we may terminate service if you attempt to use our service with an incompatible or unauthorized device.
  • Personal Use: The service is intended for your personal use only. You must not resell it to a third party.
  • Account Security: Your account is personal to you. You must not allow others to use your account, nor transfer or assign it to another person or entity. You are responsible for keeping your account password and any identification we provide you confidential.
  • Lawful Use: You must use our service only for lawful purposes. This includes not using the service for sending or storing any unlawful material or for fraudulent purposes.
  • Respectful Use: You must not use the service to cause nuisance, annoyance, or inconvenience.
  • No Harm: You must not attempt to harm our service or impair the proper operation of the network, platform, or application.
  • No Unauthorized Use: You must not copy, distribute, or otherwise use our service or any part of it without prior written permission from us.
  • Identity Verification: You may be required to provide proof of identity, which you agree to provide upon request.
  • Authorized Data Use: You must use an authorized access point or data account to access our service.
  • SMS Charges: Standard messaging charges may apply when requesting services via SMS (if available in your jurisdiction).
  • Compliance with Laws: You must comply with all applicable laws and regulations while using our service. We reserve the right to terminate your access to our service if you do not comply with these terms.
  • Local Laws: You must comply with all applicable laws of your home nation, and the country, state, and/or city where you use our service. We reserve the right to terminate your use of our service if you fail to comply with any of these terms.

5. Charges, Prices, and Payment Terms for 24Hr Car Unlock

Basic Access: Use of the 24Hr Car Unlocking Emergency Roadside Services’ platform without obtaining Provider services is free of charge for users.

Service Charges: When utilizing 24Hr Car Unlocking Emergency Roadside Services, you will incur charges for the services or goods received. These charges include our service fees and fees for third-party service providers (“Providers”) who deliver roadside assistance or towing services.

Pricing Structure: Our displayed prices for services are comprehensive, covering retail prices charged by Providers, our service fees, applicable taxes as required by law, and any additional fees such as service fees, cancellation fees, or surcharges.

Payment to Providers: Charges for services rendered by Providers are owed directly to them. We act as a limited payment collection agent for Providers, and your payment through our platform is considered a direct payment to the Provider. You retain the right to negotiate charges with Providers.

Adjustment of Charges: Providers may adjust charges based on the actual services provided, particularly if there are discrepancies between the requested and delivered services. You agree to pay any adjusted charges.

Direct Charges by Us: Some charges may be owed directly to us, separate from the service charges for Providers. Accessing our app is currently free, but fees may apply for additional services or features.

Payment Method: Charges and payments will be processed using the designated payment method in your account. If your primary payment method is invalid, we may use another available method in your account.

Price Adjustments: We reserve the right to adjust charges for services at any time and will endeavor to inform you of any applicable charges. You are responsible for all charges incurred under your account.

Refunds and Disputes: Charges are generally final and non-refundable. If you have issues with charges, such as requests for cancellations, refunds, or corrections, contact us within 30 days of the charge. Failure to do so waives your right to dispute the charges.

Service Rates: Rates for services provided by our network of roadside assistance providers are available through our platform and are subject to change. It is your responsibility to stay informed about current rates.

Payment Obligation: You agree to pay for all services procured from our providers. We will charge the credit card on file for these services, including taxes and late fees. Ensure timely payment and maintain a valid credit card on file. All payments are non-refundable, except as required by law.

Third-Party Payment Processor: We use a third-party payment processor for credit card transactions. Your use of our service and payments are subject to the terms of the payment processor and your credit card issuer.

Liability for Payment Processing: We are not responsible for errors by the payment processor. By using our service, you release us from liability for issues arising from the actions or omissions of the payment processor.

Transaction Details: We will obtain certain transaction details in connection with your use of our service, handled in accordance with our Privacy Policy.

6. Employment/Agent/Broker Relationship.

24Hr Car Unlocking Emergency Roadside Services is not an employment agency and does not serve as an employer of any user or service provider. We do not assume liability for any employment-related obligations, including but not limited to unemployment insurance, employer’s liability, social security, or payroll withholding tax in connection with the use of our services or those provided by our network of roadside assistance providers. Our relationship with users and service providers is not that of an agency, brokerage, partnership, joint venture, employer-employee, or franchisor-franchisee. We do not act as an agent or broker for any users or service providers, except as explicitly stated in these terms.

7. Indemnification

By using the services of 24Hr Car Unlocking Emergency Roadside Services, you agree to defend, indemnify, and hold harmless our company, its affiliates, licensors, and their respective officers, directors, employees, attorneys, and agents from and against any claims, costs, damages, losses, liabilities, and expenses (including attorney’s fees) arising from or related to: (a) your breach of these terms or any applicable laws or regulations; (b) your infringement of any third-party rights, including those of service providers engaged through our platform; or (c) your use or misuse of our services.

8. Limitation of Liability

By using the services of 24Hr Car Unlocking Emergency Roadside Services, you acknowledge that we and our affiliates shall not be liable for: (i) any indirect, incidental, special, consequential, or exemplary damages incurred by you, under any theory of liability. This includes, but is not limited to, loss of profit, goodwill, business reputation, data, the cost of procurement of substitute goods or services, or other intangible losses. (ii) We shall not be liable for losses or damages that may result from: (a) Changes made to our service or temporary or permanent cessation of our service. (b) Deletion, corruption, or failure to store any content or data. (c) Inaccuracies in your account information. (d) Failure to maintain the security of your account details. (e) Your use or misuse of our services. (f) Technical errors, defects, delays in operation or transmission. (g) Links to websites or content provided by third parties.

Notwithstanding the above, our cumulative liability to you for all claims related to the use of our services, whether in contract, tort, or under any other theory of liability, will not exceed $100. This limitation applies regardless of whether other provisions of these terms have been breached or if a remedy fails in its essential purpose. Some jurisdictions do not allow limitations on liability or the exclusion of certain warranties, so some or all of these limitations may not apply to you. The limitations and exclusions set forth in these terms are fundamental elements of the basis of the agreement between us.

Additionally, 24Hr Car Unlocking will not be liable for any special, indirect, incidental, punitive, or consequential damages of any kind, regardless of the cause and under any theory of liability, including contract, strict liability, or tort (including negligence). This applies even if 24Hr Car Unlocking has been advised of the possibility of such damages. This limitation of liability will remain in effect to the fullest extent permitted by law and will continue indefinitely, notwithstanding the failure of any essential remedy.

9. Disclaimer

The information, recommendations, and services provided through the 24Hr Car Unlocking Emergency Roadside Services are for general informational purposes only and do not constitute professional advice. We do not guarantee continuous, uninterrupted access to our services. While we strive to maintain the accuracy and integrity of the information, we do not warrant its correctness, completeness, or accuracy. The service may contain errors or inaccuracies and may not be complete or current. Unauthorized modifications by users or third parties could occur without our knowledge.

We cannot guarantee that our services, including our website and/or mobile application, are free of errors, defects, malware, and viruses. We reserve the right to cancel any payment due to incorrect pricing or service descriptions resulting from typographical errors or other inaccuracies.

The quality of the services requested through our platform is the responsibility of the independent service providers and any 3rd party distributers. We accept no liability for the services provided by these providers or for any actions, behavior, conduct, negligence, or omissions on their part. Complaints about the services should be directed to the respective service provider or distributer.

We cannot guarantee the quality of third-party automotive parts, as we are not the manufacturer. For any issues with defective automotive batteries or parts, customers acknowledge and agree that they must seek resolution directly from the manufacturer or warranty provider.

For all warranty issues concerning auto batteries, key fob batteries, auto remotes, and smartkeys installed through our service, please contact us directly as your initial point of contact. Be aware that any servicing performed by external shops or providers will void the warranty and absolve us of any liability.

The specific terms and conditions of our Limited Warranty for Auto Batteries are detailed on our website and found here. Please be aware that we may update these Limited Warranty terms from time to time. Changes will become effective for services scheduled after such updates are posted on our website. We encourage you to review these terms regularly to stay informed about any changes.

24Hr Car Unlocking Emergency Roadside Services and its affiliates provide services “AS IS” without any warranty, either expressed or implied. We do not guarantee that the services will meet your requirements, be uninterrupted, timely, secure, or error-free. We also do not guarantee the accuracy or reliability of any information obtained through our services. Any software provided as part of our services is not guaranteed to be free from defects. We specifically disclaim all warranties and conditions of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any advice or information obtained from us should not be considered as creating any warranty not expressly stated in these terms. Some jurisdictions do not allow the exclusion of certain warranties, so these disclaimers may not apply to you.

10. License Grant, Restrictions, and Copyright Policy

For these User Terms, the following definitions apply:

“Content” includes all content featured or displayed, such as logos, icons, trademarks, text, graphics, photographs, images, sound, illustrations, music, software (excluding our mobile application), comments, artwork, links, questions, suggestions, information, and other materials.

“Our Content” refers to Content owned or used by 24Hr Car Unlocking Emergency Roadside Services, its affiliates, or licensors, and made available through our services (including our website and mobile application), including any Content licensed from a third party, but excluding User Content.

“User Content” means Content that a user of our services posts, uploads, publishes, submits, or transmits to be made available on our website or through our services.

“Collective Content” refers to both Our Content and User Content.

Subject to your compliance with these User Terms, we grant you a limited, non-exclusive, non-transferable license:

To view, download, and print Our Content solely for your personal and non-commercial purposes.

To view any User Content, you are permitted access to, solely for your personal and non-commercial purposes.

You have no right to sublicense the license rights granted in this section. You may not use, copy, adapt, modify, create derivative works of, distribute, license, sell, transfer, publicly display, perform, reproduce, transmit, stream, broadcast, or otherwise exploit our services or Collective Content, except as expressly permitted in these User Terms. You may not reuse any Collective Content without first obtaining written consent from us. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by us or our licensors, except for the licenses and rights expressly granted in these User Terms.

11. License Granted by User

We may, in our sole discretion, permit users to post, upload, publish, submit, or transmit User Content on our services. By doing so, you grant us a non-exclusive, royalty-free, perpetual right to use, copy, publicly display, perform, modify, create derivative works of, and otherwise use or exploit, in any medium and globally, any Content you make available on our website or through our services. You warrant that your Content does not infringe any third-party rights, including intellectual property, privacy, or personality rights, and is not defamatory. You also confirm that you have all necessary permissions to post such Content and grant us these rights.

You acknowledge that we act as a passive conduit for User Content and are not responsible for its content or accuracy. We do not continuously monitor User Content nor moderate between users, and we are under no obligation to do so. You use User Content at your own risk.

You agree to indemnify and hold harmless 24Hr Car Unlocking Emergency Roadside Services, its affiliates, and licensors against all costs, expenses, damages, losses, and liabilities related to any Content you post or your use of our services.

We reserve the right to block or remove any User Content at our discretion that we believe violates these User Terms or is otherwise unacceptable.

12. Mobile Application License

Subject to your compliance with these User Terms, 24Hr Car Unlocking Emergency Roadside Services grants you a limited, non-exclusive, non-transferable license to use our mobile application. This license allows you to access our services via a single mobile device or computer that you own or control, and to run such copy of our mobile application solely for your own personal use.

You shall not: (i) License, sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit or make available our mobile application to any third party. (ii) Modify or make derivative works based upon our services or mobile application. (iii) Create Internet “links” to our services, or “frame” or “mirror” our mobile application on any other server or wireless or Internet-based device. (iv) Reverse engineer or access our mobile application to (a) design or build a competitive product or service, (b) design or build a product using similar ideas, features, functions, or graphics of our services or mobile application, or (c) to copy any ideas, features, functions, or graphics of our services or mobile application. (v) Launch automated programs or scripts, including web spiders, crawlers, robots, ants, indexers, bots, viruses, or worms, or any program that may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of our services or mobile application.

You shall not: (i) Send spam or duplicative or unsolicited messages in violation of applicable laws. (ii) Send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortious material, including material harmful to children or violative of third-party rights. (iii) Send or store material containing harmful computer code, files, scripts, agents, or programs. (iv) Interfere with or disrupt the integrity or performance of our services or the data contained therein. (v) Attempt to gain unauthorized access to our services or its related systems or networks.

We reserve the right to investigate and prosecute violations of any of the above to the fullest extent of the law and may involve law enforcement authorities. While we have no obligation to monitor your access to or use of our services, we reserve the right to do so for operating our service, ensuring compliance with these User Terms, or complying with legal obligations or governmental requests. We also reserve the right to remove or disable access to any content that we consider to be in violation of these User Terms or harmful to our service.

13. Intellectual Property Ownership

24Hr Car Unlocking Emergency Roadside Services (and its licensors, where applicable) retains all rights, title, and interest, including all related intellectual property rights, in and to our services (including our website and mobile application). Any suggestions, ideas, enhancement requests, feedback, or recommendations provided by you or any other party relating to our services are hereby assigned to 24Hr Car Unlocking Emergency Roadside Services, with all rights, title, and interest therein.

These User Terms do not constitute a sale and do not convey to you any rights of ownership in or related to our services or any intellectual property rights owned by us. Our name, logo, and the product names associated with our services are trademarks of 24Hr Car Unlocking Emergency Roadside Services, its affiliated companies, or third parties, and no right or license is granted to use them.

14. App Store Sourced Application

For any application accessed through or downloaded from the Apple App Store (“App Store Sourced Application”), you agree to use the application only on an Apple-branded product that runs iOS and as permitted by the “Usage Rules” set forth in the Apple App Store Terms of Service. We reserve all rights in the application not expressly granted to you under these User Terms.

You acknowledge that these User Terms are between you and 24Hr Car Unlocking Emergency Roadside Services only, and not with Apple. We, not Apple, are solely responsible for the App Store Sourced Application and its content. Your use of the App Store Sourced Application must comply with the App Store Terms of Service.

Apple is not responsible for any maintenance and support services with respect to the App Store Sourced Application. In case of any application failure to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the application. Apple will have no other warranty obligation whatsoever with respect to the App Store Sourced Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

You and 24Hr Car Unlocking Emergency Roadside Services acknowledge that Apple is not responsible for addressing any claims related to the App Store Sourced Application, including product liability claims, legal compliance, and intellectual property infringement.

In the event of a third-party claim of intellectual property infringement related to the App Store Sourced Application, we, not Apple, will be responsible for the investigation, defense, settlement, and discharge of any such claim.

Apple and its subsidiaries are third-party beneficiaries regarding your license of the App Store Sourced Application. Upon your acceptance of these User Terms, Apple will have the right to enforce these User Terms against you as a third-party beneficiary.

You must comply with all applicable third-party terms of agreement when using the App Store Sourced Application.

15. Third Party Interactions

During the use of our services, you may encounter links to websites owned and controlled by third parties. These links are provided for your convenience and may lead you to enter into correspondence, purchase goods or services, or participate in promotions of these third parties. These external sites are beyond the control of 24Hr Car Unlocking Emergency Roadside Services.

When you use our services and interact with third-party service providers, advertisers, or sponsors through a link on our platform, you are navigating away from our services. These third-party websites have their own terms and conditions and privacy policies. We are not responsible for their content, activities, or any transactions made through these external sites. You access these websites at your own risk, and we advise you to review their terms and privacy policies.

16. Termination of the Agreement

This agreement can be terminated by either you or 24Hr Car Unlocking Emergency Roadside Services at any time. To terminate the agreement, you must permanently delete our mobile application from your smartphone, thus discontinuing your use of our services.

We may also terminate this agreement at any time and with immediate effect, which may include disabling your access to our services. We may or may not provide advance notice of termination but will endeavor to notify you afterward if required by these User Terms.

17. Invalidity of One or More Provisions

If any provision of these User Terms is found to be unenforceable or invalid, that provision or part of it will be modified or deleted to make the rest of these User Terms enforceable and valid to the greatest extent possible under applicable laws.

18. Modification of the Service and User Terms

We reserve the right to modify these User Terms. Any changes will be posted with a new effective date. We will also notify you of any changes using the contact information you have provided. It is your responsibility to keep your account information current. We encourage you to review these User Terms periodically. If you do not agree to the modified terms, you should discontinue using our services. Continued use after the posting of modified User Terms indicates your acceptance of the changes.

19. Notice

Notices from 24Hr Car Unlocking Emergency Roadside Services may be given through a general notice on our service platform or mobile application, by electronic mail to your email address in our records, or by regular mail to your address in our records.

20. Assignment

You may not assign your rights under these User Terms without our prior written approval.

21. Applicable Law and Dispute Resolution

These User Terms and any disputes arising from or relating to these Terms will be governed by and interpreted under the laws of the State of Texas, without regard to conflicts of law principles.

If a dispute arises between you and 24Hr Car Unlocking Emergency Roadside Services, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

Any dispute that cannot be resolved amicably shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in Texas, and the decision of the arbitrator shall be final and binding. The parties agree to keep the arbitration confidential. Each party is responsible for its own attorney’s fees, and the parties shall share equally the administrative costs of arbitration.

For claims of $10,000 or less, the arbitration will be conducted based solely on written submissions unless the parties agree otherwise. For larger claims, the right to a hearing will be determined by the AAA rules.

This arbitration agreement does not preclude either party from seeking action by federal, state, or local government agencies. Both parties also retain the right to apply to any court of competent jurisdiction for provisional relief, such as pre-arbitral attachments or preliminary injunctions.

The arbitration agreement in this section is intended to be broadly interpreted and will survive the termination of these User Terms.

23. English Text
